These Terms of Use ("Terms") govern your use of the Web Remote. By opening the Web Remote or entering a session code, you agree to these Terms. If you do not agree, do not use the Web Remote.
The IFATC Companion mobile apps for iOS / iPadOS and Android are licensed to you through the Apple App Store and Google Play, under the Apple Licensed Application End User License Agreement or the Google Play Terms of Service respectively. Those agreements continue to govern the mobile apps, including any purchase. These Terms add to them for the Web Remote, which is reached through a web browser rather than through either store and so is not covered by them.
You must be old enough to form a binding contract where you live, or have the permission of a parent or guardian who agrees to these Terms on your behalf.
The Web Remote is an optional remote screen for IFATC Companion. It shows in your browser what the app on your mobile device is doing and sends your button presses back to it. All simulated ATC, all decisions about your flight, and all audio come from the app. Using the Web Remote requires IFATC Companion with Live Connected Mode access and Web Remote Mode turned on in the app; with that access it works in Mock Mode as well as when connected to Infinite Flight. The Web Remote has no charge beyond Live Connected Mode access and requires no account.
How the Web Remote handles information is described in the IFATC Companion Privacy Policy, which forms part of these Terms.
All ATC, weather, taxi, navigation, map, and aviation information in IFATC Companion, including everything shown in the Web Remote, is for flight simulation and entertainment only and must not be used for real-world aviation. It is simulated, may be incomplete, out of date or wrong, and is not a substitute for official sources, real air traffic control, or certified equipment.
IFATC Companion is an independent companion app developed by H3 Consulting Partners and is not affiliated with, endorsed by, sponsored by, or approved by Infinite Flight LLC. Infinite Flight is sold separately. "Infinite Flight" and all related names and marks are trademarks of their respective owners.
You may use the Web Remote for your own personal, non-commercial flight simulation. You agree not to:
We may end any session, block access from any source, or refuse service to anyone we reasonably believe is breaking these Terms or putting the Web Remote or its users at risk.
The Web Remote is provided on a best-effort basis with no promise of uptime or support. We may change, suspend, or discontinue any part of it at any time, with or without notice. Sessions are temporary by design: a session can end when the relay restarts, when your connection drops, after an hour of inactivity, after at most 24 hours, or when Web Remote Mode is turned off in the app. You should always be able to continue your flight in the app on your mobile device without the Web Remote.
To draw its maps, your browser loads imagery and data directly from third parties, including NASA Global Imagery Browse Services (GIBS), NOAA / the U.S. National Weather Service, and OpenStreetMap Overpass API operators, as listed under About & data sources in the Web Remote. We do not control those services and are not responsible for their availability, accuracy, or content. Your use of them may be subject to their own terms. OpenStreetMap data is © OpenStreetMap contributors and is licensed under the Open Database License (ODbL) 1.0.
The Web Remote, its software, design, and content (other than third-party data) are owned by H3 Consulting Partners LLC and are protected by copyright and other laws. Subject to these Terms, we give you a personal, revocable, non-exclusive, non-transferable permission to use the Web Remote through a web browser. No other rights are granted.
THE WEB REMOTE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE WEB REMOTE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY INFORMATION IT SHOWS WILL BE ACCURATE, COMPLETE, OR CURRENT, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE WEB REMOTE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL H3 CONSULTING PARTNERS LLC, OR ITS OWNERS, MEMBERS, EMPLOYEES, OR CONTRACTORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, OR FOR DAMAGE TO ANY DEVICE, ARISING OUT OF OR RELATED TO THE WEB REMOTE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEB REMOTE OR THESE TERMS WILL NOT EXCEED TEN U.S. DOLLARS (US$10).
Some jurisdictions do not allow certain warranties to be excluded or certain liability to be limited. In those places, the exclusions and limits above apply to the greatest extent the law allows, and nothing in these Terms limits any right you have that cannot lawfully be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless H3 Consulting Partners LLC and its owners, members, employees, and contractors from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Web Remote or your breach of these Terms.
You can stop using the Web Remote at any time by closing the page or turning Web Remote Mode off in the app. We may suspend or end your access at any time under Sections 5 and 6. Sections 3, 4, and 7 through 14 continue to apply after your use ends.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or related to the Web Remote or these Terms will be brought only in the state or federal courts located in Texas, and you consent to their jurisdiction, except where the law of the place you live gives you a right to bring a claim in your local courts that cannot be waived.
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Web Remote. If any part of these Terms is found unenforceable, that part will be enforced to the extent possible and the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms; we may transfer ours. We may update these Terms from time to time; when we do, we will revise the "Last updated" date above and post the new Terms at this URL. Continuing to use the Web Remote after an update means you accept the updated Terms.
